Gardeners Highbury Terms and Conditions of Service

These Terms and Conditions set out the basis on which Gardeners Highbury provides gardening and related services to residential and commercial clients. By making a booking, accepting a quote, or allowing work to commence, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following definitions apply:

Client means the person, company, or organisation requesting the services of Gardeners Highbury.

Company, we, us, our means Gardeners Highbury.

Services means any gardening, grounds maintenance, soft landscaping, hedge cutting, lawn care, planting, clearance, or other related work provided by the Company.

Booking means a request for Services that has been confirmed by the Company.

Site means the garden or property where the Services are to be carried out.

2. Scope of Services

We provide a range of gardening and outdoor maintenance services, including but not limited to lawn mowing, hedge trimming, planting, weeding, pruning, garden tidy-ups, seasonal maintenance, and green waste removal as agreed. The precise scope of work for each visit or project will be confirmed in writing or verbally prior to commencement and may be based on a quote or an agreed hourly rate.

The Client is responsible for ensuring the Site is accessible and suitable for the agreed Services. Any additional work requested on the day of service that falls outside the original scope may be charged separately and may be subject to availability of time, materials and personnel.

3. Booking Process

3.1 A booking may be made by the Client by contacting us and providing details of the required Services, address of the Site, preferred dates, and any specific instructions. We may request photographs or a site visit to assess the work before confirming the booking.

3.2 All bookings are subject to our availability and acceptance. A provisional date or time slot does not constitute a confirmed booking until it has been expressly agreed by us.

3.3 For larger projects or ongoing maintenance contracts, we may issue a written quote or service schedule. Acceptance of a quote, whether verbally or in writing, constitutes agreement to these Terms and Conditions.

3.4 We reserve the right to refuse or cancel any booking where we reasonably believe the work is unsafe, unsuitable, or where the Client has previously breached these Terms and Conditions.

4. Quotes and Pricing

4.1 Any quote provided is based on the information and measurements supplied by the Client or observed during a site visit. Should the actual conditions differ significantly from those described, we reserve the right to revise the quote or charge for additional work at our standard rates.

4.2 Unless stated otherwise, quotes are exclusive of materials, waste disposal charges, parking fees, and any third-party costs. These will be confirmed in advance where practicable.

4.3 Hourly or daily rates are charged from the time our team arrives on Site until the time they leave, including reasonable time for set-up, packing away and cleaning the work area.

4.4 We may review and change our standard rates periodically. For ongoing maintenance agreements, any price change will be notified to the Client in advance.

5. Payments and Invoicing

5.1 Payment terms will be confirmed at the time of booking or within the quote. Unless otherwise agreed, payment is due immediately upon completion of the Services or upon receipt of invoice.

5.2 We may require a deposit for larger projects or for bookings involving significant material costs. Work will not commence until the deposit is received. Deposits are generally non-refundable once materials have been ordered or specific dates reserved.

5.3 We accept a range of standard UK payment methods. Cash payments, if accepted, must be made directly to an authorised representative of the Company who will provide confirmation of receipt.

5.4 Invoices not paid by the due date may incur interest and administrative charges in accordance with applicable UK law. We reserve the right to suspend or cancel future bookings where outstanding balances remain unpaid.

5.5 The Client is responsible for ensuring that billing details are accurate. Any query regarding an invoice must be raised within seven days of the invoice date, after which the invoice will be deemed accepted.

6. Cancellations, Rescheduling and Access

6.1 The Client may cancel or reschedule a booking by giving us reasonable notice. For standard visits, we generally require at least 24 hours notice. For larger projects or multi-day bookings, we may require longer notice, which will be set out in the quote or booking confirmation.

6.2 If adequate notice is not given, we reserve the right to charge a cancellation fee which may be up to the full value of the booked Services, particularly where staff and materials have already been allocated.

6.3 If we are unable to gain access to the Site at the agreed time, or if the Site is not in a suitable condition for work to begin, this may be treated as a late cancellation and charged accordingly.

6.4 We may, on occasion, need to reschedule or cancel a booking due to weather conditions, staff illness, equipment failure, or other unforeseen circumstances. We will notify the Client as soon as reasonably possible and offer an alternative date or time. We will not be liable for any loss arising from such rescheduling or cancellation.

7. Client Responsibilities

7.1 The Client must ensure that we have clear and safe access to the Site for the duration of the visit, including any necessary keys, gate codes, or parking arrangements.

7.2 The Client must inform us in advance of any hazards, restrictions or special considerations at the Site, including but not limited to uneven ground, hidden cables or pipes, allergies, water supply limitations, or any local regulations affecting gardening work.

7.3 Children and pets must be kept away from the working area while work is in progress, and the Client remains responsible for their safety at all times.

7.4 If the Client supplies any materials, plants or equipment, they remain responsible for their quality and suitability. We accept no liability for failure or damage caused by items supplied by the Client.

8. Materials, Plants and Guarantees

8.1 Where we source and supply materials or plants, we aim to use reputable suppliers and appropriate products for the Site and conditions. However, natural products and living plants are subject to variation, weather conditions, pests and diseases, and we cannot guarantee their performance or longevity.

8.2 Any guarantees or warranties in relation to specific products will be limited to those provided by the original manufacturer or supplier. We will pass on relevant information where available.

8.3 The ongoing health and appearance of plants and lawns depend on correct aftercare, including watering, feeding, and maintenance. Unless we have been contracted to provide ongoing maintenance, we cannot accept responsibility for the condition of the garden after completion of the agreed Services.

9. Waste Removal and Environmental Regulations

9.1 We will handle garden waste in accordance with applicable UK regulations. Where green waste removal is included in the quote or booking, we will collect and dispose of it using appropriate facilities and methods.

9.2 Some jobs may generate additional waste, such as soil, turf, branches, cuttings, or old materials. Where this exceeds the standard allowance or requires special handling, additional charges may apply. These will be explained to the Client where reasonably foreseeable.

9.3 If waste removal is not included in the agreed Services, we will leave green waste neatly bagged or stacked in an agreed area on the Site for the Client to arrange disposal.

9.4 We will not remove or dispose of hazardous or prohibited materials. The Client is responsible for ensuring that the Site is free from such items before work begins.

10. Health, Safety and Conduct

10.1 We will carry out the Services with reasonable care and skill and in compliance with applicable UK health and safety requirements relevant to gardening and outdoor work.

10.2 Our team members must be treated with respect. We reserve the right to withdraw our staff and terminate the visit immediately where they are subjected to abusive, threatening, or unsafe behaviour. In such cases, the full booking fee may still be payable.

10.3 We will take reasonable care to avoid damage to property while working. The Client should notify us of any particularly fragile features, structures or items in the garden that require special care.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.

11.2 Subject to the above, our total liability to the Client for any loss or damage arising from or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the Services giving rise to the claim.

11.3 We are not liable for any indirect or consequential loss, including loss of enjoyment, loss of profit, or loss of opportunity, arising out of or in connection with our Services.

11.4 We will not be responsible for pre-existing faults or damage at the Site, nor for any issues arising from misuse, lack of maintenance, extreme weather events, pests, diseases, or other factors beyond our reasonable control.

12. Complaints and Disputes

12.1 If the Client is dissatisfied with any aspect of the Services, they should inform us as soon as possible, preferably within 48 hours of completion, so that we have a reasonable opportunity to investigate and, where appropriate, to rectify the issue.

12.2 We will aim to resolve complaints promptly and fairly. This may include revisiting the Site, offering advice, carrying out remedial work, or other appropriate steps at our discretion.

12.3 If a dispute cannot be resolved directly between us and the Client, either party may seek advice or pursue remedies available under UK law.

13. Data Protection and Privacy

13.1 We will collect and use personal information provided by the Client, such as name, address, and contact details, only as necessary to manage bookings, deliver Services, and administer our business.

13.2 We will take reasonable steps to keep personal data secure and will not sell or share it with unrelated third parties except where required by law or necessary to provide the Services, such as with subcontractors or suppliers involved in the work.

14. Changes to These Terms and Conditions

14.1 We may update these Terms and Conditions from time to time to reflect changes in the law, our services, or our business practices. The latest version will apply to new bookings from the date it is made available.

14.2 Where a change materially affects an ongoing contract, we will notify the Client and give them the option to accept the revised terms or to terminate future services under that contract.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the Services provided by Gardeners Highbury.

By proceeding with a booking or allowing work to commence, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
